These Terms of Service ("Terms") are an agreement between you and ARIA CAPITAL AND HUMAN PARTNERS SRL ("Mochi", "we", "us") governing your use of the Mochi website and app (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Who can use Mochi
You must be at least 16 years old to use the Service. By using it, you confirm that you meet this requirement and that the information you give us is accurate.
2. Your account
You're responsible for keeping your login credentials safe and for activity that happens under your account. Let us know promptly if you think your account has been compromised. You may close your account at any time.
3. What Mochi is — and isn't
Mochi is a study tool that uses spaced repetition to help you remember the material you add. It's an aid to your own learning, not a source of professional, medical, legal, or financial advice, and we don't guarantee any particular learning outcome.
4. Your content
The study cards and other material you create are yours. You keep all rights to them. You grant us a limited licence to store, process, and display that content solely to operate and provide the Service to you — for example, to schedule your reviews and sync across your devices.
You're responsible for the content you add, and you agree not to upload anything unlawful or that infringes someone else's rights.
5. Acceptable use
You agree not to:
- break the law or others' rights while using the Service;
- attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service;
- resell or commercially exploit the Service without our permission;
- use the Service to store or distribute malware or harmful content.
We may suspend or close accounts that break these rules.
6. Availability and changes
The Service is offered during an early-access period and is provided "as is" and "as available". We may add, change, or remove features, and we may have downtime for maintenance or reasons beyond our control. We'll try to give reasonable notice of significant changes.
7. Pricing
Mochi is currently free to use. If we introduce paid plans, we'll make the terms clear before you're charged, and any paid features will be optional.
8. Disclaimers
To the fullest extent the law allows, we provide the Service without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. Nothing in these Terms limits rights you have under mandatory consumer law.
9. Limitation of liability
To the fullest extent the law allows, we won't be liable for indirect or consequential loss, lost data, or lost profits arising from your use of the Service. Nothing here excludes liability that can't be excluded by law.
10. Termination
You can stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms or if we stop offering the Service. On termination, the licence you granted us in section 4 ends, subject to our Privacy Policy and any legal retention requirements.
11. Changes to these Terms
We may update these Terms as the Service evolves. When changes are material, we'll update the date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Romania, without regard to its conflict-of-laws rules, and subject to any mandatory consumer protections of your country of residence.
